1. Acceptance of These Terms
These Terms form an agreement between you and Bloodworth Music Ministries (“Bloodworth Music Ministries,” “the Ministry,” “we,” “us,” or “our”). By accessing or using this website, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the website or submit information through it. If you use the website on behalf of another person or an organization, you represent that you have authority to do so.
2. Ministry Purpose and Religious Character
Bloodworth Music Ministries is a Christian ministry that seeks to provide music instruction in a Christ-centered environment and to encourage students to develop their gifts for worship, service, and the glory of God.
Website content may reflect the Ministry’s religious beliefs, mission, values, and practices. Nothing on the website creates a promise that any particular program, placement, instructor, instrument, schedule, benefit, or ministry service will be available.
3. Eligibility and Minor Users
You must be at least 18 years old to submit a form, make a legal commitment, or provide information on behalf of a minor through this website. An adult student may submit information for themselves.
For minors: A parent or legal guardian must submit the student application and must provide any required permissions. Children under 13 must not submit personal information directly through the website.
Submitting a form for a minor represents that you are the minor’s parent or legal guardian, or that you otherwise have documented legal authority to act for the minor.
4. Program Information and Applications
Information about lessons, instructors, instruments, schedules, locations, age groups, or availability is general and may change. Submission of a student application:
- Is a request for consideration, not an acceptance or enrollment.
- Does not guarantee placement, timing, an instructor, or an instrument.
- Does not create an employment, agency, partnership, educational, fiduciary, pastoral-care, or other special legal relationship.
- May require follow-up information, verification, an interview, a waitlist, or completion of separate documents.
Actual participation may be governed by separate documents, including enrollment terms, attendance and conduct rules, parental consent, emergency information, medical authorization, transportation or pickup authorization, liability waivers, safeguarding requirements, and media releases. If a separate signed document conflicts with these website Terms concerning program participation, the separate signed document controls for that subject.
The Ministry may accept, decline, pause, reschedule, condition, or end participation when reasonably necessary based on capacity, safety, program fit, attendance, conduct, volunteer availability, ministry mission, or other legitimate considerations, subject to applicable law.
5. Financial Donations
Voluntary contributions
Financial contributions are voluntary and are intended to support the Ministry’s charitable and religious mission. Unless the Ministry expressly accepts a written restriction, contributions are unrestricted and may be used where the Ministry determines the need is greatest in furtherance of its mission.
Third-party processing
Online contributions are processed through third-party services, including Donorbox and Stripe. Your use of those services is also subject to their terms, privacy policies, fees, and technical limitations. The Ministry is not responsible for a third-party platform’s outage, error, delay, security incident, or unauthorized use outside the Ministry’s reasonable control.
Recurring contributions
By selecting a recurring contribution, you authorize the applicable payment provider to charge the selected amount at the chosen interval until the recurring contribution is canceled. Cancellation may be completed through the donor-management tools offered by the payment provider or by contacting the Ministry. A cancellation may not reverse a charge already processed or already in progress.
Errors, unauthorized transactions, and refunds
If you believe a contribution was duplicated, entered incorrectly, or made without authorization, contact us promptly. Except where required by law, refunds are not automatic and are reviewed case by case, considering the timing of the request, whether funds have been used or committed, transaction costs, suspected fraud, and any restrictions imposed by law or the payment provider.
Do not initiate a chargeback for a correct and authorized contribution without first giving us a reasonable opportunity to investigate. This sentence does not waive any nonwaivable right you may have under applicable law or a payment-card agreement.
Tax matters and receipts
Any statement regarding charitable status or deductibility is general information, not tax or legal advice. The deductibility and value of a contribution depend on applicable law and the donor’s circumstances. Donors are responsible for maintaining required records and consulting their own tax adviser.
When applicable, the Ministry or its donation provider may issue a written acknowledgment describing a contribution. An acknowledgment of noncash property describes the property but does not establish its fair market value.
6. Instrument and In-Kind Donations
Submission of an instrument-donation form is an offer for the Ministry to consider; it does not require the Ministry to accept the item, schedule pickup, provide storage, issue a receipt, or use the item in a particular way.
By donating an instrument or other item, you represent that:
- You own the item or have authority to donate it.
- The item is not stolen, subject to an undisclosed lien, unlawfully possessed, or knowingly dangerous.
- Your description is accurate to the best of your knowledge and discloses known material defects, contamination, pests, mold, hazardous materials, or safety concerns.
Unless the Ministry expressly agrees otherwise in writing, an accepted in-kind donation becomes the Ministry’s property. The Ministry may inspect, decline, repair, clean, store, lend, use, transfer, sell, recycle, or dispose of the item in furtherance of its mission and operational needs.
The donor is responsible for determining and documenting the item’s fair market value. The Ministry does not provide appraisals, tax advice, or guarantees of deductibility.
7. Communications
When you submit contact information, you authorize us to respond using the contact methods you provide for purposes related to your inquiry, application, donation, or ministry relationship.
Email and ordinary text messaging may not be secure. Do not send passwords, complete payment-card information, government identification numbers, or detailed medical information by ordinary email or text unless the Ministry has directed you to an appropriate secure method.
You may ask us to stop optional promotional communications. We may still send nonpromotional messages reasonably necessary to administer an active application, donation, program, safety matter, or legal obligation.
8. User Submissions
You retain ownership of content you submit, such as messages, photographs of an instrument, descriptions, or application information. You grant the Ministry a limited, nonexclusive, royalty-free license to receive, store, reproduce, review, and share that content as reasonably necessary to respond, administer the applicable request, protect safety, maintain records, and operate the Ministry.
This website submission license does not by itself authorize the Ministry to publicly advertise or publish an identifiable minor’s image, recording, name, or testimonial. Any such public use should be covered by a separate media release.
You represent that information you submit is accurate, lawful, not misleading, and that you have the rights and permissions necessary to submit it.
9. Acceptable Use
You may not use the website to:
- Violate any law or the rights of another person.
- Submit false, deceptive, defamatory, threatening, harassing, exploitative, obscene, infringing, or unlawful content.
- Impersonate another person or misrepresent your identity, authority, relationship, or intentions.
- Attempt to access accounts, systems, data, forms, or administrative areas without authorization.
- Introduce malware, malicious code, automated scraping, excessive requests, denial-of-service activity, or other interference.
- Collect information about students, families, donors, volunteers, or website users without authorization.
- Use website content or contact information for spam, commercial solicitation, fundraising unrelated to the Ministry, or unlawful profiling.
We may preserve and disclose relevant information when reasonably necessary to investigate abuse, protect safety, enforce these Terms, or comply with law.
10. Intellectual Property
Unless otherwise stated, the website and its original text, design, graphics, logos, photographs, videos, downloads, and other content are owned by or licensed to Bloodworth Music Ministries and are protected by applicable intellectual-property laws.
You may view, print, or share a link to website content for personal, noncommercial, and ministry-supportive purposes, provided you do not remove notices, misrepresent the content, imply endorsement, or use it unlawfully. Any other reproduction, modification, distribution, commercial use, or public display requires prior written permission.
Names, logos, photographs, and other materials belonging to partners, sponsors, churches, service providers, or other third parties remain the property of their respective owners.
11. Third-Party Services and Links
The website may link to or embed services operated by third parties, including donation processors, form providers, social media platforms, churches, sponsors, partners, map services, or video services.
A link, reference, sponsorship, or partnership listing does not necessarily mean the Ministry controls, guarantees, or endorses every statement, product, service, security practice, or policy of that third party. Use third-party services at your own discretion and review their terms and privacy policies.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR SECURITY.
We do not warrant that the website will be uninterrupted, error-free, free of harmful components, or that every error will be corrected. We do not guarantee that information on the website is complete, current, or suitable for your particular circumstances.
Website content is for general informational and ministry purposes. It is not legal, tax, accounting, medical, mental-health, emergency, educational, child-safety, cybersecurity, or other professional advice. You should obtain advice from an appropriately qualified professional for your specific situation.
Nothing on the website creates a confidential, fiduciary, attorney-client, therapist-client, physician-patient, formal pastoral counseling, or similar professional relationship.
Some jurisdictions do not permit certain warranty exclusions, so some of the above exclusions may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLOODWORTH MUSIC MINISTRIES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, INSTRUCTORS, VOLUNTEERS, CONTRACTORS, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, REVENUE, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM THIRD-PARTY SERVICES, WEBSITE INTERRUPTION, UNAUTHORIZED ACCESS, OR RELIANCE ON WEBSITE CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE MINISTRY FOR CLAIMS ARISING SOLELY FROM YOUR USE OF THE WEBSITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO THE MINISTRY FOR THE SPECIFIC ONLINE SERVICE GIVING RISE TO THE CLAIM DURING THE PRECEDING TWELVE MONTHS.
A charitable contribution is not considered a purchase price for a website service merely because it was submitted online.
These limitations do not exclude liability that cannot lawfully be excluded or limited, and they do not alter rights expressly granted by applicable law. Separate signed documents may govern liability associated with in-person programs or activities.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Bloodworth Music Ministries and its directors, officers, employees, instructors, volunteers, contractors, representatives, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the website, your material violation of these Terms, your infringement of another person’s rights, or content you submit.
This provision does not require you to indemnify a protected party for conduct to the extent indemnification is prohibited by applicable law.
15. Governing Law
These Terms and disputes concerning the website are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except to the extent federal law or another law must apply.
Before filing a nonemergency legal claim concerning the website, the parties are encouraged to provide written notice describing the issue and to make a good-faith effort to resolve it informally. This does not prevent either party from seeking urgent injunctive relief or meeting a legal filing deadline.
16. Suspension and Termination
We may restrict or terminate access to the website, reject a submission, or remove content when reasonably necessary to protect safety, security, legal compliance, ministry operations, or the rights of others.
Provisions that by their nature should survive termination—including intellectual-property, disclaimer, limitation-of-liability, indemnification, and general provisions—will survive.
17. Changes to These Terms
We may revise these Terms as the website, ministry, service providers, or legal requirements change. Updated Terms will be posted on this page with a revised “Last updated” date. Your continued use after the revised Terms become effective constitutes acceptance to the extent permitted by law.
18. General Provisions
Severability
If a provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will remain in effect.
No waiver
A failure to enforce a provision is not a waiver of that provision or any other right.
Assignment
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a lawful transfer, reorganization, or succession of ministry operations.
Entire agreement
These Terms and the Privacy Policy are the entire agreement concerning use of the website, except that a separate signed agreement controls the specific subject it addresses.
Headings
Headings are for convenience and do not limit the meaning of a provision.
